Terms of Service

These Terms of Service govern the contractual relationship between Nikolai Efimov (“CapsuleKit”, “we”, “us”) and clients (“you”) who commission a personal styling service via capsulekit.co.

The service is a personal styling practice operated by a human stylist who uses AI visualisation tools as part of the creative process. The styling judgement, curation, and editorial decisions are made by the stylist, not by automated systems.

We offer three service tiers. Current prices are published on the website.

Delivery timelines are estimates. The stylist will communicate any delays. We reserve the right to decline a commission if capacity is unavailable; in that case any payment made is refunded in full.

A contract is formed when the stylist sends a payment link and you complete payment via Stripe. Submission of an intake form alone does not create a binding contract.

Payment is processed exclusively through Stripe Payment Links. We do not store card details. All prices are quoted in EUR inclusive of any applicable taxes.

Styling recommendations are subjective professional opinions. We do not guarantee that recommended items will be available for purchase at the time of delivery, that prices will remain unchanged, or that items will fit as depicted.

AI-generated try-on images are visualisations only. They do not constitute a guarantee of fit, colour accuracy, or garment availability. They are labelled as AI-generated content in accordance with EU AI Act Art. 50.

By uploading photographs, you grant CapsuleKit a limited, non-exclusive licence to use those images solely to provide the agreed styling service, including transmission to our AI try-on processor (FASHN) where you have given explicit consent.

AI-generated try-on images are provided for your personal use only. Commercial use requires separate agreement.

Use of your photographs or any project materials in our portfolio, marketing, or communications requires your separate written consent and will never be assumed.

Gift certificates are valid for three years from the end of the calendar year of purchase (§ 195 BGB). A certificate is issued for one recipient and may not be transferred once redeemed.

Certificates are non-refundable once redeemed. The right of withdrawal applies to the unredeemed certificate within 14 days of purchase — see the Withdrawal notice for details.

We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and for claims under the Product Liability Act.

For ordinary negligence we are liable only for breach of a material contractual obligation (Kardinalpflicht) — i.e. an obligation whose fulfilment makes proper performance of the contract possible and on whose compliance the client regularly relies — and only to the extent of foreseeable, typical damage.

Any further liability for ordinary negligence is excluded.
